1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the GPSR Kit web application ("Service") operated by GPSR Kit ("we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

GPSR Kit is a software tool that helps businesses:

• Create EU GPSR compliance documentation
• Generate product safety labels with QR codes
• Document risk assessments
• Store and manage product technical files

The Service is provided "as is" as a documentation tool. It is your responsibility to ensure that your products comply with all applicable laws and regulations.

3. Account Terms

3.1 Account Creation

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Have authority to bind your business to these Terms
• Keep your login credentials secure and confidential

3.2 Account Responsibilities

You are responsible for:

• All activity that occurs under your account
• Maintaining the security of your password
• Notifying us immediately of any unauthorized access
• The accuracy of information you provide about your products

3.3 Account Termination

You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason at our discretion with notice.

4. Payment Terms

4.1 Pricing

We offer paid plans as described on our pricing page. Prices are in Euros (€) and include applicable taxes where required by law. We may change prices with 30 days' notice.

4.2 Payment Processing

Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your full credit card details.

4.3 Subscriptions

• Annual subscriptions renew automatically unless cancelled
• You can cancel at any time from your billing settings
• Access continues until the end of the paid period
• No prorated refunds for early cancellation

4.4 Refunds

Refund requests are handled on a case-by-case basis. Contact us at gpsrhelp@gmail.com within 14 days of purchase if you believe you are entitled to a refund. Digital services may have limited refund rights under EU consumer law once the service has been used.

You agree not to:

• Use the Service for any illegal purpose
• Create documentation for products that are illegal or dangerous
• Provide false or misleading information about your products
• Share your account credentials with others
• Attempt to access other users' data
• Interfere with the Service's operation
• Reverse engineer or copy our software
• Use automated tools to scrape or access the Service

7. Intellectual Property

7.1 Our Property

The Service, including its design, code, features, and documentation templates, is owned by GPSR Kit and protected by copyright and other intellectual property laws.

7.2 Your Content

You retain ownership of the product information and content you provide. By using the Service, you grant us a limited license to store and process your content solely to provide the Service.

7.3 Generated Documents

Documents generated by the Service (PDFs, labels, etc.) are yours to use for your business purposes. You may not resell blank templates or the document generation functionality itself.

8. Limitation of Liability

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless GPSR Kit, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your products or business activities
• Any claims that your products are unsafe or non-compliant

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with or without notice
• Modify or discontinue features
• Experience outages beyond our control

We are not liable for any losses resulting from service unavailability.

11. Governing Law & Disputes

These Terms are governed by applicable laws. Any disputes will be resolved in accordance with applicable law, except where consumer protection laws require otherwise.

If you are a consumer in the EU, you retain any mandatory consumer rights under the laws of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any plan-specific terms, constitute the entire agreement between you and GPSR Kit regarding the Service.
